Existe cuando hay m\u00e1s de un\u00a0heredero\u00a0o\u00a0legatario, y aparece regulada en los art\u00edculos\u00a01051\u00a0a\u00a01081\u00a0del\u00a0C\u00f3digo Civil.<\/p>\n

No hay que confundir la partici\u00f3n con la\u00a0aceptaci\u00f3n de herencia, ya que la partici\u00f3n de herencia est\u00e1\u00a0estrechamente relacionada con la\u00a0divisi\u00f3n de cosa com\u00fan.<\/strong><\/p>\n

Tipos de partici\u00f3n de herencia<\/h2>\n

Hay\u00a0varias clases de partici\u00f3n de herencia<\/strong>, dependiendo de qui\u00e9n la realice. Si se debe lleva a cabo judicialmente, se aplican los art\u00edculos 782 y siguientes de la\u00a0Ley de Enjuiciamiento Civil.<\/p>\n

B\u00e1sicamente, existen los siguientes\u00a0tipos\u00a0de partici\u00f3n de herencia<\/strong>:<\/p>\n

1. Voluntaria<\/h3>\n

Es realizada\u00a0por los propios herederos de com\u00fan acuerdo<\/strong>, cuando no existe\u00a0testamento\u00a0o no hay conflictos. Se formaliza mediante\u00a0escritura p\u00fablica\u00a0ante\u00a0Notario.<\/p>\n

\n

Todo coheredero que tenga la libre administraci\u00f3n y disposici\u00f3n de sus bienes podr\u00e1 pedir en cualquier tiempo la partici\u00f3n de la herencia. Lo har\u00e1n sus representantes legales si el coheredero est\u00e1 en situaci\u00f3n de ausencia. Si el coheredero contase con medidas de apoyo por raz\u00f3n de discapacidad, se estar\u00e1 a lo que se disponga en estas.<\/p>\n

Art\u00edculo 1052 del C\u00f3digo Civil<\/strong><\/p>\n<\/blockquote>\n

\n

Cuando el testador no hubiese hecho la partici\u00f3n, ni encomendado a otro esta facultad, si los herederos fueren mayores y tuvieren la libre administraci\u00f3n de sus bienes, podr\u00e1n distribuir la herencia de la manera que tengan por conveniente.<\/p>\n

Art\u00edculo 1058 del C\u00f3digo Civil<\/strong><\/p>\n<\/blockquote>\n

2. Judicial<\/h3>\n

La\u00a0divisi\u00f3n judicial de la herencia\u00a0tiene lugar cuando\u00a0no hay acuerdo<\/strong>\u00a0entre los herederos<\/strong>\u00a0acerca de c\u00f3mo repartir los bienes.<\/p>\n

\n

Cuando los herederos mayores de edad no se entendieren sobre el modo de hacer la partici\u00f3n, quedar\u00e1 a salvo su derecho para que lo ejerciten en la forma prevenida en la Ley de Enjuiciamiento Civil.<\/p>\n

Art\u00edculo 1059 del C\u00f3digo Civil<\/strong><\/p>\n<\/blockquote>\n

Este procedimiento se conoce tambi\u00e9n como\u00a0juicio\u00a0de testamentaria.<\/strong><\/p>\n

\n

1. Cualquier coheredero o legatario de parte al\u00edcuota podr\u00e1 reclamar judicialmente la divisi\u00f3n de la herencia, siempre que esta no deba efectuarla un comisario o contador-partidor designado por el testador, por acuerdo entre los coherederos o por el Letrado de la Administraci\u00f3n de Justicia o el Notario.<\/p>\n

Art\u00edculo 782.1 de la Ley de Enjuiciamiento Civil<\/strong><\/p>\n<\/blockquote>\n

3. Por contador partidor<\/h3>\n

Puede evitar la partici\u00f3n judicial.\u00a0Interviene un tercero, denominado\u00a0contador partidor<\/strong>, que puede ser designado por el propio\u00a0testador\u00a0o por los herederos.<\/p>\n

Puede ser\u00a0testamentario<\/strong>, cuando es designado por el fallecido en su testamento, o\u00a0dativo<\/strong>, si es designado por el juez.<\/p>\n

4. Otros supuestos<\/h3>\n

La partici\u00f3n se puede realizar tambi\u00e9n por:<\/p>\n

    \n
  • Un \u00e1rbitro<\/strong>\u00a0designado por los coherederos o el testador<\/strong>\u00a0para resolver extrajudicialmente las controversias.<\/li>\n
  • El propio testador<\/strong>, quien distribuye los bienes entre sus herederos. Este supuesto se denomina testamento particional.<\/li>\n<\/ul>\n
    \n

    Cuando el testador hiciere, por acto entre vivos o por \u00faltima voluntad, la partici\u00f3n de sus bienes, se pasar\u00e1 por ella, en cuanto no perjudique a la leg\u00edtima de los herederos forzosos.<\/p>\n
